Terms of Use
These Terms govern your use of Cipher Munch. Please read them carefully before downloading, purchasing, subscribing to, or using the app.
Apple Standard EULA
Cipher Munch is distributed through Apple's App Store. Apps made available through the App Store are licensed, not sold, and Apple's Licensed Application End User License Agreement applies unless a valid custom EULA says otherwise. These Terms supplement Apple's Standard EULA and do not replace it. If these Terms conflict with Apple's Standard EULA, Apple's Standard EULA controls to the extent of the conflict.
1. Acceptance of Terms
These Terms of Use ("Terms") govern your use of the Cipher Munch mobile application ("App"), published by Learning Playground Apps ("we," "us," or "our"). By downloading, installing, accessing, or using the App, you agree to these Terms. If you do not agree, do not use the App.
2. License to Use the App
Subject to these Terms and Apple's Standard EULA, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use Cipher Munch for personal entertainment and educational purposes on Apple-branded devices you own or control, as permitted by Apple's usage rules.
You may not copy, distribute, sell, rent, sublicense, modify, reverse-engineer, decompile, disassemble, or attempt to derive source code from the App except where such restriction is prohibited by applicable law.
3. App Content and Intellectual Property
The App, including its design, interface, code, graphics, app icon, puzzle systems, and original puzzle content, is owned by Learning Playground Apps or its licensors and is protected by copyright, trademark, and other laws.
Cipher Munch may include public-domain or Creative Commons-licensed quotes. Where attribution is required, attribution may be displayed in the App, on puzzle completion screens, or in credits/settings areas.
4. In-App Purchases
Cipher Munch may offer optional in-app purchases, including puzzle packs, hint bundles, or other digital content. All purchases are processed by Apple through the App Store. We do not process payments or store payment information.
Purchases are subject to Apple's payment, refund, and family sharing policies. Unless required by law or Apple's policies, in-app purchases are final and non-refundable. Refund requests should be submitted to Apple.
5. Subscriptions
If Cipher Munch offers auto-renewing subscriptions, the price, duration, and included features will be shown before purchase. Your Apple ID account will be charged at confirmation of purchase and at each renewal period unless canceled at least 24 hours before the end of the current period.
- You can manage or cancel subscriptions in Settings, Apple ID, Subscriptions.
- Cancellation takes effect at the end of the current billing period.
- Subscription billing, renewals, trials, refunds, and regional pricing are handled by Apple.
- We may change subscription features or pricing where permitted by Apple and applicable law.
6. Acceptable Use
You agree not to misuse the App. This includes, without limitation, attempts to bypass purchase verification, extract puzzle databases, scrape content, disrupt app performance, use the App unlawfully, or infringe our rights or the rights of others.
7. Privacy
Your use of Cipher Munch is also governed by our Privacy Policy. The App is designed without accounts, advertising SDKs, or tracking, and purchase processing is handled by Apple.
8. External Services
The App may interact with Apple services such as the App Store, StoreKit, purchase receipt validation, device backup behavior, or subscription management. Your use of Apple services is governed by Apple's terms and policies. We are not responsible for third-party services that we do not control.
9. Disclaimer of Warranties
To the maximum extent permitted by law, Cipher Munch is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, accuracy, quiet enjoyment, or non-infringement.
We do not guarantee that the App will be uninterrupted, error-free, compatible with every device or operating system version, or that defects will be corrected.
10. Limitation of Liability
To the maximum extent permitted by law, Learning Playground Apps will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, goodwill, or business opportunities arising from your use of or inability to use the App.
Our total liability for claims related to the App will not exceed the greater of the amount you paid for Cipher Munch or in-app purchases in the twelve months before the claim, or USD $50.00, except where a different limit is required by applicable law.
11. Termination
These Terms remain in effect while you use the App. Your rights under these Terms will terminate automatically if you violate them. Upon termination, you must stop using the App. We may discontinue the App or any feature where permitted by law.
12. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will update the effective date above and may provide notice through this website or App Store release notes. Continued use of the App after changes become effective means you accept the updated Terms.
13. Governing Law
Except where Apple's Standard EULA or mandatory consumer protection laws provide otherwise, these Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles. Nothing in these Terms limits any rights you may have under mandatory local consumer protection laws.
